    ShiftShield™ Placement Guarantee Policy

    Issued by: TLC Nursing Associates, Inc. Effective Date: September 1, 2025

    Purpose and Scope

    ShiftShield™ is a placement guarantee program that provides credentialed clinicians with income protection and job security during career transitions. It ensures that if a participating clinician resigns or ends their current role and activates ShiftShield™, TLC Nursing guarantees to find a new placement within a set period or pay the clinician a weekly wage for up to four (4) weeks.

    Scope

    This policy applies to Registered Nurses (RNs) and Allied Healthcare Professionals credentialed with TLC Nursing. Excludes LPNs, CNAs, LNAs, MHTs, BHTs, PCAs, and any other unlicensed personnel.
  3. Key Definitions
  4. Business Days:

    For this policy, business days are counted starting from the first Monday following the day the clinician submits a valid written notification (“trigger”). Saturdays, Sundays, and U.S. federal holidays are excluded.

    Trigger:

    The written request submitted by a clinician to activate ShiftShield™. The request must clearly state that they are leaving their current job. This can be done by email or through an official online form. For further clarification, the guarantee time begins only when the staff's credential file is complete and verified by TLC Nursing, including all required licenses, certifications, and background checks

    Trigger Date:

    The Monday following the date of the trigger notification.

    Valid Assignment:

    A job offer that meets all of the following:
    • lty: Matches the clinician’s primary, secondary, or related specialties. Clinicians must also float down. (Example: Med-Surg RN may be placed in Telemetry)
    • Location: Anywhere in the U.S., including Alaska, and Hawaii
    • Shift: No shift restrictions; includes days, evenings, nights, weekends, and holidays.
    • Compensation: The prevailing market rate for the professional and specialty. TLC will match documented competitor offers
    • Contract type: For travel, 4 weeks to 6 months in length

    Market Rate:

    Determined by TLC Nursing based on current industry benchmarks and internal pay tables at the time of the offer.

    Credentialed:

    A clinician who holds valid, active, unencumbered licenses in California, New York, Illinois, Massachusetts, Connecticut, and Alaska.  A clinician must also have unexpired specialty certifications and have completed state background checks for the following states: California, New York, Illinois, Massachusetts, Connecticut, and Alaska.

    Primary/Secondary/Related Specialty:

    Designations maintained by TLC Nursing based on the clinician’s documented qualifications and work history.
  5. Program Eligibility
    • Must be fully credentialed with TLC Nursing.
    • Must have valid, active licenses in all of the following states: California, New York, Illinois, Massachusetts, Connecticut, and Alaska.
    • Must have required specialty certifications.
    • Must be in good standing (no misconduct, terminations for cause, or license suspensions).
  6. Program Activation and Timeline
  7. Activation Steps
    1. The Clinician submits a written trigger request.
    2. The 14- or 28-business-day clock begins the first Monday following the request.
  8. Guaranteed Timelines
    • Travel assignments: Placement guaranteed within 14 business days.
  9. Candidate Obligations
    • Must accept any valid assignment offered. Declining a valid offer voids the guarantee.
    • Failure to respond will be deemed a refusal.
    • Cannot impose additional contingencies after triggering.
    • Cannot request time off during the contract period.
    • Must maintain credentials in good standing.
  10. Pay Guarantee
  11. If TLC Nursing fails to secure a valid placement within the guaranteed timeframe:
    • TLC will begin paying weekly wages starting the day after the 14 business day deadline.
    • Payments continue weekly until placement starts, up to a maximum of 4 weeks.
    • Wages are based on market rates at the time of payment.
    • Wages are only paid if an assignment is not found.  
    • Assignments that start in future dates are considered valid placements and do not qualify for any wages. 
    • Assignments with confirmed start dates within 30 calendar days of offer acceptance are considered valid placements and do not qualify for payout.

    Exclusions:

    • Assignments ended due to clinician misconduct, license suspension, or termination for cause.
    • If a valid assignment is refused.

    Payment Nature:

    Payments are a program benefit and not an advance on future earnings.
  12. Frequency of Use
  13. Clinicians may trigger ShiftShield™ an unlimited number of times, as long as they meet eligibility requirements.
  14. Program Termination and Modifications
  15. TLC Nursing reserves the right to modify or terminate ShiftShield™ with 14 days’ notice.

  17. Example – Travel Trigger:

    Notification sent on Wednesday, January 7th, 2026. The first Monday is January 12th, 2026. 14-day business window ends on January 30th, 2026.
  18. Appeals
  19. If a clinician disputes that an assignment was valid, they may submit a written appeal to TLC Nursing’s Program Review Board. Decisions are final. Appeals must be submitted within 5 business days of offer issuance. Appeals submitted later will not be considered.

    How It Works

    For Travel Assignments:

    • Tell us you’re leaving: Submit a written request.
    • We guarantee a new job within 14 business days.
    • If we don’t place you within 14 business days, we pay you every week (for up to 4 weeks) until you start a new assignment.

    For Permanent Jobs:

    Same process, but the guarantee window is 28 business days instead of 14.

    Your Part

    • You must be fully credentialed (licenses, certifications, and background checks done in CA, NY, IL, MA, CT, and AK).
    • You must accept any valid offer we give you. No restrictions on location, pay, or shift.
    • If you turn down a valid offer, ShiftShield™ ends.

    What is a Valid Offer

    • Matches your primary, secondary, or related specialty.
    • Anywhere in the U.S. (including Alaska and Hawaii).
    • Includes any shift (days, nights, weekends).
    • Pay is at least 70% of market rate. (We’ll match a competitor’s offer if you have proof.)

    Payments

    • If we miss the deadline, we pay you weekly based on market rates.
    • Maximum of 4 weeks of pay.

    No payments if:

    • You were terminated for cause.
    • You lose your license or certifications.
    • You refuse a valid assignment.

    How It Works

    What does “business days” mean? Business days are counted Monday–Friday, excluding weekends and U.S. federal holidays.
    What if I resign midweek? The countdown starts on the first Monday after you submit your written trigger request.

    Assignments and Offers

    What counts as a valid assignment? A valid assignment must:
    • Match your primary, secondary, or related specialties (float-down applies).
    • Be located anywhere in the U.S. (including Alaska and Hawaii).
    • Be any shift (days, nights, weekends, holidays).
    • Pay at or above prevailing market rates (TLC will match documented competitor offers).
    • Be a contract of 4 weeks to 6 months for travel roles.
    What if I refuse an assignment? Declining a valid offer voids your ShiftShield™ coverage.
    What if I don’t respond to an offer? Non-response is considered a refusal.

    Pay Guarantee

    What happens if TLC can’t place me in time? If we fail to secure a valid travel assignment within 14 business days (or perm within 28 business days), TLC will pay you weekly wages until placement begins, for up to 4 weeks.
    How much will I be paid? Payments are based on market rates at the time of payment.
    Are payments considered an advance? No. Payments are a program benefit, not an advance on future earnings.
    Are there situations where I won’t be paid? Yes. No payments are made if:
    • You refuse a valid assignment.
    • You are terminated for cause.
    • Your license or credentials are suspended or expired.
    • You request time off during a contract period.

    Usage and Limits

    How often can I use ShiftShield™? Unlimited times, as long as you remain eligible.
    Can TLC Nursing change or end the program? Yes. TLC may modify or terminate ShiftShield™ with 14 days’ notice.

    Appeals

    What if I think the assignment offered wasn’t valid? You may appeal in writing to TLC Nursing’s Program Review Board within 5 business days of the offer. The Board’s decision is final.
